Ship Arrest Seminar at Maybank, 3 November 2015

The team at Messrs Fuzet Farid had the privilege of conducting a Ship Arrest Seminar for the senior management of Malayan Banking Berhad (Maybank) at Menara Maybank, Kuala Lumpur on 3 November 2015. Presented before a group of 20 participants, the seminar was conducted with a focus on the legal and commercial aspects concerning the arrest of ships in Malaysia.

The presenters, including our Managing Partner, Fuzet Farid, and the participants were involved in a highly interactive seminar, as the participants posed questions mainly from the perspective of a mortgagee in ship arrest claims. Our Danial Nizam and Mathew David also shared their experiences in conducting ship arrest, ranging from the actual arrest of a vessel at anchorage at Labuan to the appearance before the Sheriff and the Admiralty Court Judge at the Admiralty Court in Kuala Lumpur.

The Ship Arrest Seminar was an excellent platform for knowledge-sharing and networking for us at Fuzet Farid and the senior management at Maybank.

International Bar Association Annual Conference, Vienna, 8 October 2015

Our Managing Partner, Fuzet Farid, presented a conference paper entitled "Malaysian Shipping Tax - The Current Tax Structures used in Malaysian Shipping" before shipping law practitioners from all over the world at the International Bar Association (IBA) Annual Conference in Vienna, Austria on 8 October 2015. Fuzet Farid is a renowned feature among the international shipping law practitioners at the IBA, having previously published an article entitled "Consequential Losses in Long Term Contracts of Affreightment under Malaysian Law" in the IBA Maritime and Transport Committee Newsletter in May 2015.

As a background, Mr Godofredo Mendes Vianna of Kincaid - Mendes Vianna Advogados Associados, currently the Vice Chair of the Maritime and Transport Law Committee, was responsible to chair and organise a Session on the topic “Tax For Shipping - are tax haven jurisdictions really the best destination for shipowners and vessels operators?” where several aspects of tax structuring for ship/rig owners and operators would be discussed amongst different jurisdictions. The said Session was a joint session between the Maritime and the Taxes Committees of the IBA.

Our Fuzet Farid was invited by the IBA Maritime and Transport Law Committee as one of the panel members consisting of six other distinguished speakers. Considering the sharp and high standards of presentation by the speakers, it was no surprise that the session was filled with critical questions and constructive debates between the speakers and the participants. The session received overwhelming response from the audience, including from members of the publishing sector.

A Visit to Castor Leader at Pasir Panjang Terminal, Singapore

It was an enjoyable day out of the office and onto the shipyard as the members of the Women’s International Shipping and Trade Association of Singapore (WISTA Singapore) visited the Panamanian-flagged car carrier, the Castor Leader at the Pasir Panjang Terminal, Singapore on 2 October 2015. Our Fuzet Farid, a member of WISTA Singapore, was a part of the entourage together with her esteemed peers. 
                                 
                                    
                                          
The current hazy conditions engulfing South East Asia proved to be no hindrance for the women of WISTA Singapore, as they braved the elements to have a closer look at the Castor Leader. The women of WISTA Singapore were treated to a tour aboard the 199m × 34m roll-on roll-off (RoRo) vessel, where the visitors were acquainted with her day-to-day operations.

The visitors were introduced to the operational aspects taking place aboard the Castor Leader by the ship master. While on board, the visitors witnessed the loading and unloading of thousands of Toyota-branded cars aboard the car carrier - a process which makes a bulk of the operations of the Castor Leader.

The visit turned out to be a productive one for the members of WISTA Singapore. It was an evening of networking and knowledge sharing as the women of WISTA Singapore were treated to the scene of sunset at the Pasir Panjang Terminal.

WISTA Singapore was established in 1998 as a non-profit organisation, providing a networking forum for female professionals involved in shipping, trading and related business within the maritime industry.

WISTA Singapore is a national chapter of WISTA – the first to be founded in Asia, made-up of women professionals working from diverse companies such as ship owners, trading houses, bunkering houses, ship brokers, chartering, ship management, insurance, finance and the law.

Mathew David
Associate

Mathew David is a qualified Advocate & Solicitor of the High Court of Malaya based in Kuala Lumpur. Prior to joining Messrs Fuzet Farid, Mathew practiced in the areas of oil and gas, energy and utilities at a major Kuala Lumpur firm. He has advised international and local clients on environmental law, company and corporate law and laws relating to oil and gas. Mathew also has experience in conducting due diligence exercises involving international oil and gas corporations and advising on bespoke oil and gas contracts, such as Gas Transportation and Supply Agreements and Unitisation and Unit Operating Agreements.



Mathew graduated with a Bachelor of Laws, LL.B (Hons) from the University of Malaya. He was thereafter called to the Malaysian Bar, commenced pupillage and practiced at a major Kuala Lumpur firm before joining Fuzet Farid in September 2015.

Fie See is a corporate finance lawyer and is primarily involved in areas of corporate takeovers, mergers and acquisitions, loan / debt restructuring, corporate finance, initial public offerings and other capital raising exercises in the debt and equity markets. She has experience in offshore transactions and in various industries including insurance, banking and financial, telecommunications, oil & gas, manufacturing, real estate, property development and tourism.






Fie See graduated with a Bachelor of Laws, LL.B (Hons) from University of Malaya. She was thereafter called to the Malaysian Bar, commenced pupillage and practiced at major Kuala Lumpur law firms. She then joined a multinational world’s leading tourism group and advised the group on business, corporate, legal and secretarial affairs in MEAPAC, before she joined Fuzet Farid Singapore in September 2015. She has also obtained a Master of Laws (LL.M.) with distinction from University of Malaya where her courses included company law and civil litigation.

Messrs Fuzet Farid wishes both Mathew and Fie See a warm welcome to Messrs Fuzet Farid and Fuzet Farid Singapore respectively.

In-house training at TNB Fuel Services Sdn Bhd

On 16 June 2015, Messrs Fuzet Farid was invited by our clients TNB Fuel Services Sdn Bhd ('TNBF'), a subsidiary of Tenaga Nasional Berhad to conduct an in-house training to its staff from various departments. Our Managing Partner, Fuzet Farid had the honour to conduct this one day training held at TNBF Training room with thirty (30) participants. The training was specifically conducted in view of our role as the transactional lawyer in the recent review of their contracts to carry a percentage of the twenty (20) million metric tonnes annual coal tonnage requirements, with emphasis on their vessel ownership requirements.The training was divided into two parts which were on transactional shipping and dispute resolution as applied to their contracts. We take this opportunity to thank TNBF and the participants for contributing and engaging with us during the training.

International Bar Association Maritime and Transport Law Conference, Geneva, 7-8 May 2015


Our Managing Partner, Fuzet Farid, attended the IBA Maritime and Transport Law Conference in Geneva, Switzerland on 7-8 May 2015. She met up with old friends whom she has known since the first IBA Conference she attended in 2000 in Amsterdam, and made new friends. She is a frequent speaker at IBA Conferences though this time published an article in the IBA Maritime and Transport committee newsletter of May 2015 entitled Consequential Losses in Long Term Contracts of Affreightment under Malaysian Law

Firm Trip 2015

This year we travelled to Penang in early February for our annual Firm Trip. The activities mostly revolved around eating glorious Penang food and sightseeing around Georgetown.
